Terms of Contract
1. The mare owner shall pay a non-refundable booking fee of $200.00 . The booking fee is due payable to Julie Gruetzman upon the execution of this contract.
2. The mare owner shall pay the remaining stud fee of $__________, veterinary and mare care expenses before the mare leaves Thistle Ridge. Mare care will be charged at a rate of $____________per day wet/dry for the 2008 breeding season.
3. Before time of breeding the mare owner is required to have hind shoes removed from mare, and a veterinary note showing a clean culture on the mare and that she is up to date on inoculations.
4. Thistle Ridge agrees to try and settle the mare, however if the mare fails to settle for any reason the mare owner shall not hold Thistle Ridge accountable.
5. This contract contains a live foal guarantee. A live foal is described as a newborn that is able to stand and nurse unassisted. If the foal is born dead or dies before it is able to stand and nurse the mare owner has return privileges for the 2009 breeding season as long as Thistle Ridge is notified within a 7 day period and a veterinary note is provided in a reasonable time thereafter. The live foal guarantee is expressly contingent upon the mare owner properly caring for the pregnant mare. Proper care shall include, but shall not necessarily be limited to , proper feeding and nutrition, regular deworming with products approved for pregnant mares, vaccinations that are customary in the mare owners geographical area, and proper intervention during foaling if necessary. If a licensed veterinarian determines that the mare is unsuitable for breeding, the mare owner may substitute a new mare. The substitute mare shall be bred under the same terms and conditions as the original mare. . If the stallion this mare is booked to dies or becomes unfit for breeding the mare owner may choose to breed to another of the Thistle Ridge Stallions actively standing at that time. With Loki’s Fire additional breeding fees to make up the stud fee difference will be required.
6. A breeders certificate will be issued when the mare owner contacts Thistle Ridge verifying a life foal.
7. The mare owner is urged to obtain appropriate insurance. The failure of the mare owner to obtain appropriate insurance shall not in any fashion , act to transfer the liability for the injury ,death or illness of the mare and/or her foal to the stallion owner. The mare owner does, therefore, agree to hold the stallion owner and employees harmless from any and all liability for the death, injury or illness of the mare and/or her foal. Utmost care will be given in the care of the mare and foal by Thistle Ridge.
8. Shipped Semen Thistle Ridge assumes responsibility only to deliver live semen in viable condition at the time of delivery to the mare owner or agent. The mare owner shall assume all responsibility for the condition of the mare and shall bear all risk of loss or damage to the mare whatsoever by death, disease, injury, infection or otherwise , and by any cause whatsoever including inappropriate, untimely, or negligent insemination or failure of insemination, and therefore releases , discharges, indemnifies and holds harmless Thistle Ridge/stallion owner, or its employees from any liability for any and all damages associated therewith. The mare owner hereby agrees to pay all expenses associated with the insemination of the mare.
9. The mare owner agrees to use the shipped semen only on the mare named above in this contract and shall have a licensed veterinarian or mare handling facility verify in writing that the shipped semen has been used only to inseminate the mare named above in this contract. The mare owner agrees to deliver such certification to Thistle Ridge when the mare is confirmed in foal.
10. The mare owner agrees only to artificially inseminate mares in accordance with their breed registries. Thoroughbred mares bred to Parisianprospector or Loki’s Fire are not allowed to utilize the shipped semen option.
11. The per collection cost will be $150. Shipping extra. We will be shipping in a disposable shipper to save on the shipping costs of having to return an equitainer.
12. This contract is non-transferable.
